PRELIMINARY ARTICLE – PREAMBLE

This privacy policy is intended for users (hereinafter "the User") of the website https://aimentors.fr (hereinafter the "Site").

The Site is published by AI Mentors, a simplified joint-stock company (SAS) with a capital of 1000 euros, whose head office is located at 106 avenue de Candau, 33600 Pessac, registered under SIREN number 937752921 (hereinafter "the Provider").

The purpose of this policy is to inform the User about the nature of the personal data processing implemented on the Site and within the framework of the AI automation support services.

The Provider undertakes to respect the essential principles of the GDPR:

  • Collect only data that is strictly necessary for its purpose.
  • The User remains the owner of their personal data.
  • Data is processed in a transparent, confidential, and secure manner.
  • Data is kept only for a duration not exceeding that necessary for the purposes for which it is processed.

The processing of personal data is governed in particular by Law No. 78-17 of January 6, 1978, and by Regulation (EU) 2016/679 of April 27, 2016 ("GDPR").

In accordance with Article L.223-2 of the French Consumer Code, the User may register on the "Bloctel" telephone anti-solicitation list: https://www.bloctel.gouv.fr/.

ARTICLE 1 – PURPOSES OF PROCESSING

Data is collected for explicit and legitimate purposes, to ensure:

  • The proper functioning and continuous improvement of the Site and its features;
  • The management of contact requests, quotes, and service orders;
  • The management of customer relations, invoicing, and the monitoring of support missions;
  • Where applicable, the processing of professional data communicated by the User via third-party AI tools within the strict framework of the consulting and automation mission;
  • The management of the User's subscription to the Site's newsletter (if applicable);
  • The management of requests for the right of access, rectification, opposition, etc.;
  • Compliance with legal and regulatory obligations (especially accounting);
  • The development of commercial statistics and audience measurement for the Site.

ARTICLE 2 – DATA CONTROLLER

ARTICLE 3 – DATA COLLECTED

The Provider collects the following data:

  • Identification data: last name, first name, email, phone number, postal address, company name.
  • Connection data: IP addresses, connection logs, cookies.
  • Professional data: information transmitted as part of consulting missions.
  • Billing and transaction data.

This data is collected when browsing the Site, making a contact request, subscribing to a service, or to the newsletter.

ARTICLE 4 – CONSENT

For purposes not essential to the performance of the contract or a legal obligation (e.g., sending the newsletter, depositing certain cookies), the Provider undertakes to obtain the User's explicit consent.

ARTICLE 5 – RECIPIENTS OF THE DATA

The following will have access to the data:

  • The Provider's staff.
  • Subcontractors who act in the name and on behalf of the Provider, including:
    • Site Host: Hostinger
    • Payment Solution: Stripe, Paypal
    • Emailing and Newsletter Solution: Mailchimp, Brevo
    • Audience Analysis Tool: Google Analytics
    • Appointment Scheduling Tool: Calendly
    • AI API Providers (as part of missions): OpenAI, Google, Anthropic, Perplexity…
  • Courts, mediators, accountants, and lawyers as needed.
  • The User's data is never sold or rented to third parties.

ARTICLE 6 – DATA RETENTION PERIOD

Data is kept for a limited period:

  • For prospects: 3 years from the last contact.
  • For customers: 3 years from the end of the commercial relationship.
  • Billing data: 10 years from the closing of the financial year.
  • Cookies: 13 months maximum from their deposit on the terminal.

ARTICLE 7 – USER'S RIGHTS

In accordance with the GDPR, the User has the following rights: right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), portability (Art. 20), opposition (Art. 21), and the right to lodge a complaint with the CNIL (the French data protection authority).

To exercise these rights, the User may contact the Provider at the addresses mentioned in Article 2.

ARTICLE 8 – USE OF COOKIES

The Site uses cookies to improve the user experience, measure audience, and ensure its proper functioning. On the first visit, a banner informs the User of the use of cookies and allows them to accept, refuse, or configure them. Only cookies essential to the functioning of the Site do not require consent.

ARTICLE 9 – DATA SECURITY

The Provider implements appropriate technical and organizational measures (e.g., HTTPS protocol, secure access) to ensure the security and confidentiality of the data.

ARTICLE 10 – TRANSFER OUTSIDE THE EUROPEAN UNION

The User is informed that some data may be transferred outside the European Union, particularly when the subcontractors mentioned in Article 5 are located in the United States (Google, Mailchimp, Calendly, OpenAI).

These transfers are secured by means of the appropriate guarantees provided for by the GDPR, in particular by the adoption of the Standard Contractual Clauses of the European Commission.

ARTICLE 11 – MODIFICATION OF THE POLICY

The Provider reserves the right to modify this policy at any time. The new version will be applicable upon its publication on the Site.
